According to legal experts, deported individuals do not face any criminal charges in India unless they used fake passports or forged documents to enter the US. Delhi Bar Council Chairman KK Manan clarified that those with fraudulent documentation could face legal action under the Indian Passport Act. Indian authorities are expected to scrutinize returnees to verify their travel history and ensure that further illegal migration attempts are curbed. Migration Restrictions, Visa Bans, and Smuggling Crackdown

The Punjab Government, along with the Ministry of Home Affairs (MHA), has intensified its crackdown on human smuggling, filing 38 FIRs against illegal travel agencies suspected of exploiting vulnerable individuals.
In response to the growing issue, the Indian government is implementing measures to prevent further exploitation. The Punjab Prevention of Human Smuggling Act, 2012, is being actively enforced to prosecute illegal recruiters. Authorities are also strengthening cyber monitoring to identify and remove online advertisements from fraudulent migration agencies that target aspiring immigrants with false promises. External Affairs Minister S. Jaishankar has reaffirmed India's commitment to assisting its citizens while ensuring they do not fall victim to human trafficking networks.
